“Personal information” indicates personal information as defined in the Act on the Protection of Personal Information. Article 5 Altering the Purposes of Use

1. Our company will not provide personal information to a third party without obtaining the customer’s consent in advance, except in cases set forth below. However, this excludes cases permitted under the Act on the Protection of Personal Information and other laws and regulations.

1-1 Cases in which there is a need to protect the life, wellbeing, or property of an individual, and it is difficult to obtain the consent of the identifiable person

1-2 Cases in which there is a special need to improve public wellbeing or promote healthy child development, and it is difficult to obtain the consent of the identifiable person

1-3 Cases in which there is a need to cooperate with a national government organ, local government, or person entrusted thereby with performing the functions prescribed by laws and regulations, and obtaining the consent of the identifiable person is likely to interfere with the performance of those functions

1-4 Cases in which the following matters are announced or disclosed in advance, and our company has submitted a notification to the Personal Information Protection Commission:

・The fact that the purpose of use includes provision to a third party

・The data items to be provided to a third party

・The means or methods of provision to a third party

・The fact that the provision of personal information to a third party will discontinue at the request of the identifiable person

・The method for receiving the identifiable person’s request

2. Notwithstanding the previous paragraph, a party to which the information has been provided is not considered a third party in the cases set forth below.

2-1 Cases in which our company entrusts part or all of the personal information handling within the scope necessary to achieve the purposes of use

2-2 Cases in which personal information is provided for business succession due to mergers or other such circumstances

2-3 Cases in which the personal information is provided to specific persons who have joint use of the personal information, and we notify the identifiable person in advance of this situation, as well as the personal information details jointly used, the extent of the joint users, the users’ purpose of use, and the name and title of the person responsible for managing the personal information; or we made the information readily accessible to the identifiable person.

 

Article 8 Accessing Personal Data

Our company allows customers seeking disclosure of personal information or records of provision to a third party to request disclosure, except in cases set forth below.

1. Cases in which disclosure is likely to harm the life, wellbeing, property or other rights or interests of the identifiable person or a third party

2. Cases in which disclosure is likely to seriously interfere with the proper implementation of our company’s business

3. Cases in which disclosure would violate any other law or regulation

4. Cases in which we cannot confirm the request for disclosure came from the identifiable person

 

Article 9 Discontinuing the Use of Personal Information

When a customer requests our company discontinue the use or delete (“discontinue the use”) personal information for reasons of information being handled beyond the scope of the purposes of use or personal information being obtained by unjust means, we will conduct the necessary investigations without delay.

If the investigation reveals grounds making it necessary to comply with that request, we will discontinue the use of the personal information without delay.

If our company will discontinue the use or decides not to discontinue the use, we will notify the customer to that effect without delay.

If discontinuing the use requires a costly expenditure or proves otherwise difficult, and alternative measures necessary to protect the customer’s person’s rights and interests can be taken, we will implement these alternative measures.
